In a landmark move toward decentralizing Nigeria’s electricity sector, the Nigerian Electricity Regulatory Commission (NERC) has officially transferred regulatory oversight of the electricity market in Bayelsa State to the newly established Bayelsa State Electricity Regulatory Agency (BYERA). This transition, effective August 21, 2025, marks a significant milestone in the implementation of the Electricity Act 2023 (Amended).
The transfer empowers Bayelsa State to independently regulate electricity generation, transmission, distribution, and retail within its jurisdiction. This shift aligns with the constitutional amendment of March 17, 2023, which granted states legislative autonomy over electricity matters, removing the previous limitation to areas not covered by the national grid.
“This transition reflects our commitment to a more localized, responsive, and investment-friendly electricity market,” said a spokesperson from NERC. “Bayelsa now has the authority to shape its energy future in line with the needs of its people.”
The newly formed BYERA will oversee all aspects of electricity regulation in Bayelsa, including licensing, tariff setting, consumer protection, and market development. The move is expected to catalyze rural electrification, attract private investment, and improve service delivery across the state.
